1. Truthfulness of Information
I, the undersigned, solemnly declare under penalty of perjury under the laws of Malawi that all information, documents, and representations provided in this application are true, accurate, and complete to the best of my knowledge. I acknowledge that any misrepresentation, omission, or fraud may result in:
- a) Criminal prosecution under Sections 319—321 of the Penal Code of Malawi (False Declarations);
- b) Immediate cancellation of the loan facility; and
- c) Blacklisting with credit institutions and regulatory authorities.
2. Consent to Verification
I irrevocably consent to Capital Plus Limited (CPL), its agents, or affiliated institutions:
- a) Conducting credit checks, due diligence, and verification of all submitted documents and statements; and
- b) Sharing my data with the Malawi Revenue Authority, Department of the Registrar General, Reserve Bank of Malawi, and other regulatory bodies as required by the laws of Malawi.
3. Acknowledgement of Default Consequences
3.1
I accept full liability for repayment and acknowledge that defaulting on this loan shall entitle CPL to:
- i. Seize and liquidate collateral without further notice;
- ii. Report my default to credit institutions, impairing my future credit access;
- iii. Charge penalty interest at 5% per month on overdue amounts; and
- iv. Pursue legal recovery, including civil suits and asset forfeiture, with costs borne by me.
3.2
I shall hold CPL harmless against all claims, losses, or liabilities arising from my breach of this agreement, including legal fees incurred in recovery efforts.
